TERMS & CONDITIONS

Welcome to Glanceivory! These Terms & Conditions apply to every order you place in our online store. Please read them carefully before placing an order.

 

§ 1 SCOPE

1.1 These Terms & Conditions apply to all contracts concluded through our online store glanceivory.com between you and:

(hereinafter "we", "us" or "our").

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional (§ 13 BGB). A business customer is a natural or legal person or a partnership acting in the exercise of their commercial or self-employed professional activity (§ 14 BGB).

1.3 Any deviating terms of the customer do not apply unless we expressly agree to them in writing.

 

§ 2 CONCLUSION OF THE CONTRACT

2.1 The presentation of products in our online store is not a legally binding offer, but a non-binding invitation to place an order.

2.2 You can add products to the shopping cart and then go to checkout. There you enter your details and choose a shipping and payment method. Before placing your order, you can review all details and correct any input errors using the usual keyboard and mouse functions or by going back to previous steps.

2.3 By clicking the order button ("Place Order & Pay"), you submit a binding offer to purchase the products in your shopping cart.

2.4 We will confirm receipt of your order by email immediately after it is placed (order confirmation). This order confirmation constitutes our acceptance of your offer, and the contract is concluded with it.

2.5 The contract is concluded in English.

 

§ 3 STORAGE OF THE CONTRACT TEXT

We store the contract text. You will receive the order details and these Terms & Conditions by email with your order confirmation. You can also view these Terms & Conditions on our website at any time. If you have a customer account, you can view your past orders there.

 

§ 4 PRICES AND SHIPPING COSTS

4.1 All prices are final prices in euros (EUR). As a small business owner within the meaning of § 19 UStG (German VAT Act), we do not charge VAT, so no VAT is shown.

4.2 Shipping costs are not included in the product prices. They are shown in the shopping cart and at checkout before you place your order. More information can be found on our Shipping & Payment page.

4.3 For deliveries to countries outside the European Union, additional costs such as customs duties, import taxes or fees may apply in individual cases. These are not included in our prices and must be paid by you.

 

§ 5 PAYMENT

5.1 You can pay using the payment methods shown at checkout.

5.2 Payment is due immediately upon conclusion of the contract, unless a different due date is stated for the selected payment method.

5.3 If you are in default of payment, we are entitled to charge default interest at the statutory rate.

 

§ 6 DELIVERY

6.1 We deliver to the delivery address you provide during checkout. Delivery times are stated on the product page or on our Shipping & Payment page.

6.2 If a product is unavailable because we were not supplied by our supplier through no fault of our own, we may withdraw from the contract. In that case, we will inform you immediately and refund any payments already made without delay.

6.3 For consumers, the risk of accidental loss or deterioration of the goods passes to you only when the goods are handed over to you. This also applies to shipping.

 

§ 7 RETENTION OF TITLE

The goods remain our property until full payment has been made.

 

§ 8 RIGHT OF WITHDRAWAL

Consumers have a statutory right of withdrawal. Full details are given in our Right of Withdrawal page, together with the Withdrawal Form. You can also withdraw online via the "Withdraw from contract" button on our website.

 

§ 9 STATUTORY WARRANTY

9.1 The statutory warranty rights (gesetzliche Mängelhaftung) apply.

9.2 For consumers, the limitation period for warranty claims for new goods is two years from delivery of the goods.

9.3 If a defect appears within one year of delivery, it is presumed that the goods were already defective at the time of delivery, unless this presumption is incompatible with the nature of the goods or the defect.

9.4 Any additional guarantee from us or a manufacturer, where offered, does not limit your statutory rights. Its terms are stated in the respective product information.

 

§ 10 TRANSPORT DAMAGE

If goods are delivered with obvious transport damage, please report this to the carrier as soon as possible and contact us at support@glanceivory.com. If you do not do so, this has no consequences for your statutory claims and their enforcement, in particular your warranty rights. It helps us assert our own claims against the carrier or transport insurance.

 

§ 11 LIABILITY

11.1 We are liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or through gross negligence, under the German Product Liability Act (Produkthaftungsgesetz), and in the case of a guarantee we have given.

11.2 In the case of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract.

11.3 Otherwise, our liability for slight negligence is excluded.

11.4 These limitations do not apply to your statutory warranty rights.

 

§ 12 CUSTOMER SERVICE AND COMPLAINTS

§ 13 CONSUMER DISPUTE RESOLUTION

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

 

§ 14 APPLICABLE LAW

14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

14.2 If you are a consumer whose habitual residence is in another country, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

 

§ 15 FINAL PROVISIONS

If any provision of these Terms & Conditions is or becomes invalid, the validity of the remaining provisions is not affected.
